JURISDICTION AND APPLICABLE LAW
Lebanon competent courts in Beirut, will have exclusive jurisdiction over any claim arising from, or related to, a visit to the Web Site or in-store although NLC SAL retains the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.
These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the Laws of England.

NLC SAL is committed to protecting the privacy of visitors to its Web Site and in-store. NLC SAL analyses aggregate and non-personally identifiable data relating to usage of the Web Site. Information provided at the time of registration or submission will not be used for any unsolicited communication. TERMS AND CONDITIONS FOR BOUTIQUE AND ORDER SALES
Definitions
"Buyer"means the person purchasing any of NLC SAL goods.
NLC SAL means Nada Le Cavelier SAL.
"Personalized Jewellery" means any items of jewellery that is created or altered by NLC SAL in accordance with the Buyer's specifications (this includes but is not limited to items with customized design).
"Website" means the website at www.nadalecavelier.com
Basis of Contract
• These Conditions apply to the contract to the exclusion of any other terms that the Buyer seeks to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.
• The buyer's order for the goods as set out overleaf ("order") constitutes an offer by the buyer to purchase the goods in accordance with these Conditions. The buyer is responsible for ensuring that the terms of the order and any applicable specification relating to Personalized Jewellery is complete and accurate at the time of submitting the order to NLC SAL.
• The contract shall come into existence strictly upon the Buyer's payment in full being received by NLC SAL.
• Any samples, drawings, descriptive matter, or advertising produced by the NLC SAL and any descriptions or illustrations contained in the NLC SAL's catalogues, brochures or Website are produced for the sole purpose of giving an approximate idea of the goods described in them. They shall not form part of the contract or have any contractual force.
Payment and Delivery
• Risk in the goods will pass to the Buyer on collection or dispatch, title in the goods will not pass to the Buyer until payment is received in full.
• The price of the goods is inclusive of amounts in respect of value added tax (VAT), unless otherwise stated.
Delivery, carriage and insurance costs are the responsibility of the Buyer and are payable at the time of purchase or of placing the order. Any transportation arranged on behalf of the Buyer in relation to the goods is at the sole risk of the Buyer. The Buyer may seek an insurance, unless the Shipping insurance is automatically added to the total amount. Insurance must cover the full price of your purchased item should the item be stolen or lost during shipping.
Import Duties and Customs
The recipients of the purchased jewellery is liable for all import duties, customs or local taxes applied by the country they are receiving the shipment in, and should be paid upon arrival of the package. Some countries may hold the goods until payment is completed. These taxes and duties will not be calculated in your purchase on our website as we are not always able to get this information.
ExchangePolicy
• Products with personalized engravings or modifications will not be exchanged.
• Any other approved exchange should be done within /30/ thirty days of purchase provided your jewel is in perfectly new condition in its package of origin and accompanied by the original sales invoice. Credit notes issued on exchange must be used within twelve months of being issued.
• Where a Buyer has ordered a ring re-sizing, NLC SAL may, at its sole discretion, decide to provide a credit note in exchange for the ring. For the avoidance of doubt, the ring must have been purchased by the Buyer in a NLC SAL store.
• Refunds will only be given against goods which are faulty, and will be subject to proof of purchase; any such refunds will be by the same means of payment as used for the original purchase.
Shipping and Insurance
Shipping and insurance will be automatically added to your total amount once your shipping address has been filled in. Insurance will cover the full price of your purchased item should the item be stolen or lost during shipping.
Cancellation policy
A transaction may be cancelled within the first 12 hours following the time of payment , the full amount will be returned to the customers credit card account. Any fees charged by the clients credit card or banks are not NLC sal's responsibility.
Intellectual Property Rights
• Copyright, trademarks, and other intellectual property rights in all materials or content contained in NLC SAL's catalogues, brochures or Website, are owned by NLC SAL.
• The Buyer may not do any of the following:
• Copy, reproduce, distribute, republish, download, display, post, transmit, commercially exploit or create derivative works of any part of NLC SAL's catalogues, brochures or Website. This prohibition applies, but is not limited, to any photographs, sketches, models and other forms of reproduction whether in 'faux bijoux' (or any other medium ext), graphics, animations, pictures, data, images, audio and video clips available from the catalogues, brochures or Website;
• download, edit, reproduce or use any material and content contained within the catalogues, brochures or Website for the purpose of publicity, advertising, promoting, or for any other commercial purposes; or
• Create and/or publish its own database that features substantial parts of the catalogues, brochures or Website (including without limitation prices and product listings).
• The Buyer may print off one copy, and may download extracts, of any page(s) from the Website for its own personal reference and the buyer may draw the attention of others to material posted on the Website.
Our Liability
• Nothing in these Conditions shall limit or exclude NLC SAL 's liability for:
• Damages due to its negligence, or the negligence of its employees, agents or subcontractors (as applicable);
• fraud or fraudulent misrepresentation;
• Any matter in respect of which it would be unlawful for NLC SAL to exclude or restrict liability.
• NLC SAL shall under no circumstances whatever be liable to the Buyer, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, loss of business, loss of savings, or any indirect, special, economic or consequential loss arising under or in connection with the contract.
• NLC SAL's total liability to the buyer in respect of all other losses arising under or in connection with the contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price of the goods.
General
• No failure or delay by a party to exercise any right or remedy provided under this agreement or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.
• The contract constitutes the entire agreement between the parties. The Buyer acknowledges that it has not relied on any statement, promise or representation made or given by or on behalf of NLC SAL which is not set out in the contract. Nothing in this sub-clause shall limit or exclude any liability for fraud.
• The rights and remedies provided under this contract are in addition to, and not exclusive of, any rights or remedies provided by law.
• If a provision of this contract (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of this contract, and the validity and enforceability of the other provisions of this contract shall not be affected. If a provision of this contract (or part of any provision) is found illegal, invalid or unenforceable, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.
• A person who is not a party to this contract shall not have any rights under or in connection with it.
• NLC SAL may assign any benefit or transfer, delegate or sub-contract any of its duties or obligations under this contract.
• This contract shall be governed by and construed in accordance with the laws of England and the parties submit to the exclusive jurisdiction of the Lebanese courts.
Waiver
Our failure to exercise or enforce any right or provision of these Terms of Use will not constitute a waiver of such right or provision. If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give maximum effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms of Use remain in full force and effect.
TERMINATION
We may change, suspend or discontinue this website at any time. We may restrict, suspend or terminate your access to the Website and/or its services if we believe you are in breach of our Terms of Use or applicable law, or for any other reason without notice or liability. We will revoke the Website use privileges of users who are repeat infringers of intellectual property rights. We shall undertake any and all the above at our entire discretion. All provisions of the Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
